Terms of Service

Welcome to QR Party. These Terms of Service ("Terms") govern your use of the QR Party mobile application, website at partywithqr.com, and related services (collectively, the "Service"), provided by QR Party LLC ("QR Party," "we," "our," or "us"). By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 13 years old to use QR Party. If you are under 18, you represent that you have permission from a parent or legal guardian to use the Service. If you are using QR Party on behalf of a business or organization, you represent that you are authorized to bind that entity to these Terms.

2. Your Account

To use most features of QR Party, you must create an account and provide accurate information, including your name, email, password, and zip code. You are responsible for keeping your password confidential and for all activity that occurs under your account. Notify us immediately at klaus37f@gmail.com if you believe your account has been compromised.

You may close your account at any time by contacting us. We may suspend or terminate your account as described in Section 15.

3. The Service

QR Party lets hosts create events, generate unique QR codes, and invite guests to RSVP, claim checklist items, contribute to wishlists, and share photos. Some features are free; others require a one-time purchase or subscription as described in Section 5.

4. Your Content

"Your Content" means any information you submit to QR Party, including event details, wishlist items, checklist items, RSVPs, photos, thank-you notes, and messages.

Ownership

You own Your Content. We do not claim ownership of the events, photos, or information you submit.

License You Grant Us

By submitting Your Content, you grant QR Party a worldwide, non-exclusive, royalty-free license to host, store, reproduce, display, and distribute Your Content solely as needed to operate, provide, and improve the Service. For example, this lets us show your event on the Explore tab if you mark it public, display photos on the Picture Wall to invited guests, and send host notifications to your guests.

Your Responsibility for Your Content

You are solely responsible for Your Content and the consequences of sharing it. You represent that you have the rights necessary to submit Your Content and that it does not violate any law or third-party right.

Photo Wall and Guest Photos

Photos uploaded to an event's Picture Wall are visible to the host and other guests of that event. By uploading a photo, you grant the host and other guests the ability to view, like, and download that photo within the app. Do not upload photos of people who have not consented to being photographed and shared.

5. Payments, Subscriptions, and Fees

Personal Accounts

Personal accounts include all core features at no cost, with limits on archived event storage and photo retention. Personal users may create public events for a one-time fee of $2.99 per public event and may purchase one-time storage upgrades.

Business Accounts

Business accounts are available on a paid subscription at $9.99 per month or $79.99 per year. New Business accounts include a 14-day free trial. After the trial, your subscription will automatically renew at the then-current rate until canceled. You can cancel anytime through Google Play or by contacting us; cancellation takes effect at the end of the current billing period.

Headquarters Accounts

Headquarters accounts are available on a paid subscription at $19.99 per month or $159.99 per year and include everything in Business plus an Organization Page (one QR code linking to all of your organization's upcoming events), recurring events (weekly, monthly, or custom schedules), white-label stickers (your logo in place of the QR Party™ mark — the QR code itself is unchanged), unlimited archived events, and 2-year photo storage. New Headquarters accounts include a 14-day free trial and otherwise renew, cancel, and bill on the same terms as Business accounts described above.

Promotional Accounts

We may from time to time grant complimentary Business or Headquarters access to partner organizations. Promotional accounts have a fixed expiration date stored in your account. When that date passes, the account automatically reverts to a Personal account, and any Business or Headquarters features become unavailable unless you start a paid subscription.

Wishlist Marketplace

When a guest contributes to or purchases a wishlist item through QR Party, payment is processed by Stripe, Inc. QR Party charges a platform fee of 5% to 10% per transaction. QR Party is not the seller of third-party goods listed on wishlists and is not responsible for the quality, delivery, or fitness of those goods.

Printful Invitations and Stickers

Physical invitations, stickers, and other printed merchandise are produced and fulfilled by Printful, Inc. QR Party charges a platform fee of 10% to 15% per Printful order. Shipping, returns, and product quality for Printful orders are governed by Printful's terms.

Explore Boost

Hosts may pay to feature public events on the Explore tab. Boost prices are displayed in the app at the time of purchase and are non-refundable once the boost period begins.

In-App Purchases

Subscriptions and in-app purchases on Android are processed through Google Play Billing and are subject to Google Play's terms. Except where required by law or expressly stated otherwise, all fees are non-refundable. We do not offer prorated refunds for partial subscription periods.

Taxes

Prices do not include taxes unless stated. You are responsible for any applicable taxes on your purchases.

7. Child Safety Standards

QR Party has a zero-tolerance policy toward Child Sexual Abuse and Exploitation ("CSAE"). This includes, without limitation, any content or behavior that sexually exploits, abuses, endangers, or grooms a child, child sexual abuse material ("CSAM"), sextortion of a minor, or trafficking of a minor.

QR Party strictly prohibits CSAE anywhere on the Service, including in photos, wishlists, event descriptions, profile information, or any other user-generated content.

If QR Party becomes aware of CSAE or CSAM on the Service, we will immediately remove the content, terminate the responsible user's account, and, where required by law, report the content to the National Center for Missing & Exploited Children (NCMEC) and/or relevant law enforcement.

You can report suspected CSAE, CSAM, or any other safety concern directly within the app, or by emailing klaus37f@gmail.com. Reports are reviewed promptly by our team. If you believe a child is in immediate danger, contact local law enforcement immediately.

8. Public Events and Explore

If you mark an event "public," event details (including title, date, location, description, and host name) will be visible to other QR Party users in your area on the Explore tab. Do not mark an event public if you do not want that information visible. You can change an event's privacy in the Edit Event screen.

9. Notifications

By creating an event, you agree that hosts may send push notifications, emails, or in-app messages to guests who RSVP. By RSVPing, you agree to receive those notifications from the host. You can manage notification preferences in Settings.

10. Intellectual Property

QR Party, the QR Party logo, "QRParty™," "scan · party · connect," and all related marks are trademarks of QR Party LLC (registration pending). The Service, including its software, design, and content we provide, is protected by copyright and other intellectual property laws. Nothing in these Terms grants you any right in our intellectual property except as expressly permitted here.

11. Third-Party Services

QR Party relies on third-party services to operate, including:

Your use of these third-party services is subject to their respective terms. We are not responsible for the acts, omissions, or policies of third parties.

12. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY LAW, QR PARTY DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the Service will be uninterrupted, error-free, or secure, or that events, RSVPs, photos, or messages will always be delivered or preserved. You use the Service at your own risk.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, QR PARTY AND ITS OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, GOODWILL, OR EVENT ATTENDANCE, ARISING OUT OF OR RELATED TO THE SERVICE. Our total liability for any claim arising out of these Terms or the Service will not exceed the greater of (a) the amount you paid QR Party in the 12 months before the claim arose, or (b) USD $100. Some jurisdictions do not allow these limitations, so they may not apply to you.

14. Indemnification

You agree to indemnify and hold harmless QR Party LLC and its officers, employees, and agents from any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising out of Your Content, your use of the Service, your violation of these Terms, or your violation of any law or third-party right.

15. Termination

You may stop using the Service at any time. We may suspend or terminate your access — including by removing events or content — if we reasonably believe you have violated these Terms, created risk for other users, or created legal exposure for QR Party. On termination, the following sections survive: 4 (license to Your Content already submitted), 7, 10, 12, 13, 14, 16, and 17.

16. Governing Law and Disputes

These Terms are governed by the laws of the State of California, without regard to conflict-of-laws principles. Any dispute arising out of or related to these Terms or the Service will be resolved exclusively in the state or federal courts located in Monterey County, California, and you consent to personal jurisdiction there. Nothing here prevents either party from seeking injunctive relief in any court of competent jurisdiction.

17. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you through the app, by email, or by posting a notice on partywithqr.com at least 7 days before the changes take effect. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

18. Miscellaneous

If any provision of these Terms is found unenforceable, the remaining provisions will remain in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our written consent; we may assign them to an affiliate or successor. These Terms, together with our Privacy Policy, are the entire agreement between you and QR Party regarding the Service.
